摘要:借助人类学决策十字阵的视角,本文通过向下、向上、向前和向后四个面向论述了食品安全权及其法律保障。其中,食品安全权作为一项基本权利顺乎了人的自然本性,即安全食品是人类“来自下方的”一项基本需求,并在“来自上方的”自由和安全的价值衡量中,通过立法目的选择了安全优先兼顾经济的这一价值平衡导向。在此基础上,通过总结过去和启发未来的时间视角,进一步阐述了食品安全立法优先保障安全的历史原因和保障“同一健康”的新兴趋势。

The development of legislation on food safety: basic need, safety priority, and “One Health”
Abstract: Under the framework of the Anthropological Cross of Decision-making, this paper is going to address food safety right as well as its legal guarantee from the perspective of downwards, upwards, backwards and forwards. Accordingly, taking food safety right as a basic right corresponds with human nature, namely, safety food is a fundamental need “from below”。 Besides,with the value balance between freedom and safety which come “from above”, the purpose of legislation in this regard has prioritized the safety while taking into account economic development. Based on this, the historical reason to prioritize the safety protection and the rising tendency of “One Health” will be further addressed in a timeframe of past and future.
